Say It Ain’t So Joe! News: As the 2010 NFL free agency period continues to get closer, several teams will look to lock-down their elite-level stars to prevent them from jumping ship to another team. It doesn’t look like the Carolina Panthers will be one of those teams. Free agent defensive end Julius Peppers spoke to Chris McClain of WFNZ’s “The Mac Attack” on Monday afternoon and was asked if he wanted to talk about a long-term deal to stay with Carolina. “Last year, at the time, that was the option I wanted most,” Peppers said. “But now it’s not.” Read more here.

Officer: U.S. missionaries had tried to take other Haitian kids

Port-au-Prince, Haiti (CNN) — The American missionaries in Haiti facing kidnapping charges for trying to take 33 children out of the country last week made an earlier, unsuccessful attempt at taking dozens of other children, a Haitian police officer said.

The officer did not want to be identified for fear of reprisals. He told CNN on Monday that he had stopped the 10 Baptist missionaries, including group leader Laura Silsby, on January 26 as they tried to transport 40 children from Haiti to the Dominican Republic.

The officer said he discovered Silsby and the nine other Americans on a bus in Port-au-Prince's Pétionville neighborhood after receiving a tip from a concerned citizen.

He stopped the group and ordered the children to get off the bus. He then directed Silsby to the Dominican Embassy.

“I said what happened, and she [Silsby] told me, 'I have the paperwork to cross the Haitian-Dominican border with 100 children,' ” the officer said. A former attorney for the group, Edwin Coq, said the officer has testified of his account.

Prosecutors questioned the officer last week in the case against the missionaries. Prosecutors no longer suspect him of any wrongdoing, and he is now a witness, according Coq, who is familiar with the prosecution's case file.

The 10 missionaries were charged Thursday with kidnapping children and criminal association for trying to take 33 children out of Haiti.

Earlier Monday, Jorge Puello, a Dominican attorney who said he was hired to represent the group, said they had authorization from the Dominican Republic to bring the children across the border.

Puello showed reporters a manila folder he said contained documents that prove the Americans had authorization to bring the children into the Dominican Republic, but he did not show the documents to reporters.

Dominican authorities have said the Americans did not have permission, and Puello did not say whether the group had the authorization of Haitian officials.

The Americans have said they were trying to help the children get to a safe place after January 12's magnitude-7.0 earthquake, which has left more than 200,000 dead.

Arriving outside the Haitian attorney general's office Monday, Puello said a church hired him that counts some of the jailed Americans among its members. He did not identify the congregation.

Coq announced over the weekend that he had resigned. Puello said Monday that Coq had been fired but gave no details.

Some of the Americans have said they thought they were helping orphans, but their interpreters said this week that they were present when group members spoke with some of the children's parents.

Some parents in a village outside Port-au-Prince said they had willingly given their children to the Americans, who promised them a better life. The parents also said they had been told they could see their children whenever they wanted. But the Dominican consul general has said he warned the group's leader, Silsby, about trying to cross the border without proper documents.

Silsby and four other Americans arrived for an appearance before an examining judge Monday. One of them, Paul Thomson, referred reporters to a passage in the New Testament book of 1 Corinthians, in which the apostle Paul tells early Christians, “It seems to me that God has put us apostles on display at the end of the procession, like men condemned to die in the arena.”

The passage continues, “To this very hour we go hungry and thirsty, we are in rags, we are brutally treated, we are homeless. We work hard with our own hands. When we are cursed, we bless; when we are persecuted, we endure it; when we are slandered, we answer kindly.”

“Eggs, milk and bread,” Gibbs read from the black ink stains on his palm, claiming he was going to “make pancakes” for his son Ethan.

“But I crossed out bread,” he added, pointing to the line that, indeed, x-ed bread off the list.

“Then I wrote down hope and change just in case I forgot them.”

Obama Rebukes Boehner In Testy Exchange, Charges GOP Wants To Kill All His Initiatives

At the private White House meeting today between Obama and Congressional leaders, the President and John Boehner got into a testy exchange, aides say, with Obama charging that the GOP is just out to kill all his initiatives.

According to aides familiar with the discussion, Boehner made the case that long-term concern over Dem policies — health care, cap and trade — was leading to uncertainty in the private sector, damaging job creation efforts. Boehner said the only way to get the economy moving again is to put these issues behind us.

That apparently irked the President, aides say, who accused Boehner of just wanting to kill all his initiatives. Boehner shot back that this was false, that Republicans are serious about bipartisan cooperation.

That prompted the President to push back again, aides say, arguing that the White House isn’t getting enough credit for the part of the stimulus that boosts federal funding for state Medicaid programs, arguing it has had a positive effect on the economy.

The dispute also spilled over into a discussion of Obama’s proposal for a bipartisan fiscal commission on how to get control over the deficit.

Obama asked Boehner and Mitch McConnell if they were prepared to commit to appointing members to the commission. Boehner pushed back, aides say, arguing that if the White House is serious about cutting spending, he should should start now, and suggested Obama use his rescissions authority to send spending cut proposals to the Hill.

Boehner pledged GOP cooperation if Obama sent such proposals to Congress. But he and McConnell refused to commit to appointing members to the commission.

It’s gonna be a long year.

Using Sarah Palin's defense of Rush Limbaugh against her, last night Stephen Colbert proudly pronounced that “Sarah Palin is a f–king retard.”

After mocking Palin's speech at the Tea Party Convention (taking the obligatory jabs at the notes on her hand) Colbert moved on to Palin's reaction to Rahm Emanuel's use of the word “retard.” Palin not only called for his Emanuel's firing, but also defended Rush Limbaugh's use of the word, deeming it acceptable because it was satire.

After playing the clip of Limbaugh's “subtle” satire, Colbert jumped on the opportunity that his own satirical show presented. An opportunity to call Palin a “f–king retard.” Colbert added that her reasoning also explained the note on her other hand: “Retard = sometimes funny.”

My frustration is that there's a real and continuing story here, one worth reporting, but one which requires the Times to see the black community as something more than an undifferentiated mass, for which a small class of intellectuals, politicians and ministers are presumed to speak.

The traditional elite – the powerbrokers – have never been comfortable with Obama. For the most part, they backed Hillary Clinton in the primaries, and were taken aback when their own supporters, constituents, and congregants broke ranks to support Obama. Overwhelmingly so, I might add. They were left scrambling to catch up, following instead of leading. The designated commentators – Juan Williams, Tavis Smiley, Cornel West – quite simply failed to understand how powerful the prospect of a black president would prove.

In October of 2007, well before the South Carolina primary, the Times ran an article headlined: “Clinton Obama Quandary for Many Black Women.” Another piece, essentially an updated rewrite of the first, focused on the supposed agonizing conflict ten days before the primary. (Obama eventually won 80% of support from black men, and 78% from black women – a statistically insignificant difference.) A Janny Scott piece just after Iowa included this gem of a sentence: “Black leaders, like black voters, have been split in their support for the candidates.” This was the drumbeat early in the primary season – that the Clinton/Obama matchup amounted to an agonizing choice, particularly for black women. But it simply wasn't true. In fact, in most cases, the gender split between black men and women was smaller than the split between white men and women. In New York, home of Clinton and the Times, the supposed divide within the black community received much ink, including a piece by Sam Roberts – but the gender split was an identical 13 points among both white and black voters.

The real split was generational, economic, and stylistic. It was, in the language of Obama's brilliant Selma speech (one for the anthologies) the divide between the Moses Generation and the Joshua Generation – between a discourse of the struggle for freedom, and one of the struggle to build a new and normalized existence. The younger a black voter, the more likely they were to back Obama over Clinton. In 2008, the old gave way to the new.

But these changes are never simple, and they're never easy. There's an entire infrastructure of institutional leadership that, though hollowed out, will continue to endeavor to demonstrate its relevance. So we hear from Michael Eric Dyson, a man whose scholarship is devoted to demonstrating the pivotal centrality of race in the American experience – and suprise! he thinks Obama should be talking more about race. The Kirwan Institute, reports the Times, solemnly released a statement resolving that their own focus – race and ethnicity – is of paramount importance and ought to receive more attention. Ellie Tatum, publisher of the Amsterdam News, agrees. So does Elijah Cummings.

But if those perspectives are valid and worthwhile, they are not exclusive. Gallup publishes a weekly summary of its presidential-approval tracking poll. During Obama's first week in office, his approval rating among black voters was 86%. It's based on a subsample, so there's a fair amount of natural variability built in. But in the year since, it's ranged between 86-96%.

Ellie Tatum tells us that the more revealing question would be: “Is he doing a good job for African-Americans?” There's something rather wonderful about that formulation. In the argot of another prominent ethnic group, what the Times is really asking in the piece is the equivalent of, “Nu, but is he good for the Jews?” If, as Tatum asserts, that question would generate much lower levels of approval, one is left to ponder the apparent paradox – black voters seem to think that Obama is doing a very good job, but that he's not doing much to target support to the black community as a group. Instead, he's reframing initiatives in terms of the common good, even if they stand to have a disproportionately positive impact on disadvantaged minorities. Is it possible that this is why some of them think he's doing a good job, or is that too heretical a thought for the Times to broach?

Sarah Palin had notes written on her hand at the same moment that she was making fun of Obama for using a teleprompter. One of the radio “hosts” who makes fun of the teleprompter daily said that Palin's notes on her hand were “endearing.” The “host” also blamed Obama for televising his day with the Republican leadership, saying that if he was serious, he would have done it in private. This was after a solid month of daily beatings for not making the health care negotiations public.

The Democratic Party can now be assured forever that nothing, nothing, nothing they will do will stop the insanity. Or Sean Insanity, whatever you want to call it. If they are hoping for good publicity from the majority media, (yes, I'm sorry Fox, but you are now the highest rated news network) forget it. Writing on the hand is okay, teleprompter is not. Opening up health care is okay, opening up the meeting with Republicans is not. It would not surprise me if Ashton Kutcher popped out of the West Wing and told Obama that he has been punk'd.

The swift boat ad that killed John Kerry was not an aberration, it was just the beginning. They took a man who actually served in Vietnam and made him a coward compared to a man who didn't. And people bought it. Now it's everywhere. Right is wrong, wrong is right, crazy is normal, good is bad, hot is cold. I am not sure what the anti-Christ's plan is, but I can't imagine this is not part of it.

Steele Charges Critics With Racism: RNC Takes Heat 'Because A Black Man Is Chairman'

RNC Chairman and designated GOP sparkplug Michael Steele finds himself the center of attention once again this week — this time for an interview published in February's issue of Washingtonian magazine in which he charges his critics with racism.

Near the end of the story, called “Up In The Air” by Paul West, Steele implies that he and the RNC face more scrutiny because he is black:

Steele acknowledges that at times he has a tendency to take things too far. “And I get checked on that, just as when I was a young boy and I pushed the envelope too far and my Mama was there to check me.”
But there's an edge to his voice when he talks about a double standard that he believes has been applied by his critics, and he posits racism as the cause: “I don't see stories about the internal operations of the DNC that I see about this operation. Why? Is it because Michael Steele is the chairman, or is it because a black man is chairman?”

Totally unrelated – OMG! This reminds me! Remember I told yu'll my 4-year old granddaughter knocked out her front teeth. When they got done my daughter was telling how the dentist and her office were a “regular Bennetton ad.” [There were these wonderful ads when she was a kid and she was talking about them.]

Anyway – the dentist is Iranian (Dr Maryem Hesami). In the waiting room was one couple from Sudan with 2 kids; another mother, Mexican, with her 2 kids; another couple with their little boy who were from Albania. The kids were all playing together – the adults were conversing with each other in their own language or the staff in English. My daughter said it was just TOO MUCH!

Sarah Palin is putting together a campaign team, and Washington is taking notice. Mark Leibovich of the New York Times described her bare-bones political operation. Here is what I know: she is not worried about fundraising right now. Pam Pryor, a former RNC senior adviser, leads Palin's political action committee and is orchestrating her outreach to social conservatives. Randy Scheunenmann remains her policy maestro, with informal assistance from his Orion Strategies colleague Michael Goldfarb, the former Weekly Standard writer and McCain campaign rapid responder. (Goldfarb did not return an e-mail seeking comment about his future in Palin's world.) Fred Malek is perhaps the single Washington establishment figure that Palin turns to, although Malek has insisted that he is neutral about the presidential race — though he admits to having a soft spot in his heart for Palin.

It turns out that the criticism surrounding the decision to read Miranda rights to the attempted Christmas bombing suspect didn't originally come from any office-holding Republican.

Rather, it was pioneered by Tom Ridge and Dick Cheney in the days after Christmas, and only later picked up by members of Congress like Rep. Pete Hoekstra (R-MI) and Sen. Kit Bond (R-MO).

With the heated Obama-GOP back-and-forth this week over the Mirandizing of Umar Abdulmutallab, we decided to look back at the facts of what happened, and when critics pounced on the issue.

One notable fact is that Abdulmutallab was criminally charged by the Justice Department on Dec. 26, just a day after the incident. At that point, it would have been fair to assume that Abdulmutallab had been read his rights.

Here's the rest of what we found:

Dec. 25

Abdulmutallab is captured in Detroit after the alleged bombing attempt. “Shortly after 3:30 p.m.” FBI agents begin what would be a 50-minute interrogation of Abdulmutallab at the hospital, according to the AP.

The agents deliberately decide not to initially inform Abdulmutallab of his rights (e.g. to remain silent, to consult an attorney).

(There is a public safety exception to the Miranda rule — though it's unclear if the FBI agents had it in mind. It arises from the 1984 Quarles case, in which the Supreme Court ruled that police could ask an arrestee about matters that could threaten public safety before reading the arrestee his rights. The police in the case asked the arrestee where he had hidden a gun.)

After 50 minutes, the agents end the interrogation after Abdulmutallab was given medication “and the investigators decided it would be better to let the effects of the drugs wear off before pressing him further,” according to the AP. After he went into surgery for several hours, a second, “clean” team of agents came in to interrogate Abdulmutallab.

According to the AP, “FBI bosses in Washington had decided a new interrogation team was needed. They made that move in case the lack of a Miranda warning or the suspect's medical condition at the time of the earlier conversations posed legal problems later on for prosecutors.”

Abdulmutallab is read his rights “nearly 10 hours” after the attempted attack, according to the AP. That would be roughly 9 p.m. After he was read his rights, he did not speak to the second team, the AP reported.

The Washington Post reported the next day that Abdulmutallab was charged in the U.S. District Court for Eastern Michigan. He was informed of the charges at University of Michigan hospital by U.S. District Judge Paul D. Borman.

In the first instance we could find of a prominent Republican going after Obama on the Miranda issue, former Homeland Security Secretary Tom Ridge says on Larry King:

“I take a look at this individual who has been charged criminally, does that mean he's going to get his Miranda warnings? Does that mean the only kind of information we want to get from him is if he volunteers it. He's not a citizen of this country. He's a terrorist, and I don't think he deserves the full range of protections of our criminal justice system embodied in the Constitution of the United States.”

CNN highlights Ridge's comments for a standalone article and they are subsequently repeated ad nauseum on cable.

Rep. Peter King (R-NY) calls out the Obama Admin for putting Abdulmutallab in the criminal justice system. “My concern is that we did miss the opportunity, because once we put him into the criminal justice system, he gets a lawyer and Miranda rights,” he says, apparently the first sitting Republican to raise the issue.

Politico goes up early in the morning with an exclusive statement from Dick Cheney:

“As I've watched the events of the last few days it is clear once again that President Obama is trying to pretend we are not at war. …. He seems to think if he gives terrorists the rights of Americans, lets them lawyer up and reads them their Miranda rights, we won't be at war. “

The media goes wild; Cheney's comments are picked up far and wide.

Obama Communications Director Dan Pfeiffer takes to the White House blog to respond to Cheney for engaging “in the typical Washington game of pointing fingers and making political hay.”

In the following days, a handful of Republicans — including Michele Bachmann and Jim DeMint — picked up on the Miranda criticism, a Nexis news archive search shows. But it wasn't until a week or even two weeks after the Cheney comments exploded that any of the four Republicans engaged in the dispute with Brennan seized on the issue.

The first instance we can find on Nexis or congressional Web sites — admittedly not comprehensive sources — of Hoekstra, Bond, Boehner, or McConnell mentioning the issue is a statement from Hoekstra on Jan. 13, more than two weeks after Abdulmutallab was criminally charged. Hoekstra also said Dec. 30 that Abdulmutallab should have been handled as an enemy combatant, but did not mention the Miranda issue.

Marc Thiessen Suggests That Killing Terrorists Poses A National Security Risk

Former Bush speechwriter and torture-thrillist Marc Thiessen has, of late, been mounting some sort of prolonged campaign of pure, mountain-grown idiocy. He reached a new plateau today with a piece that essentially bitches about how President Barack Obama's success at eliminating terrorists is putting the country in danger. I know: What?

Just so we're clear, let the record state that Thiessen agrees that Obama is doing a good job killing terrorists. I found this out by searching his article for the phrase, “to be sure,” which I knew was in there somewhere!

To be sure, unmanned drones are critical in the struggle against al Qaeda. They allow the United States to reach terrorists hiding in remote regions where it would be difficult for special operations forces to reach them, or to act on perishable intelligence when the only choice is to kill a terrorist or lose him. Constantly hovering Predator (or Reaper) drones also have a psychological effect on the enemy, forcing al Qaeda leaders to live in fear and spend time focusing on self-preservation that would otherwise be used planning the next attack. All this is for the good.

Okay, that said, Thiessen's basic problem here is that with all this eliminating of the terrorist threat, Obama is harming our ability to detain and torture terrorists for their valuable intelligence.

This is an example of what pisses me off about progressives. So called progressives identify with labor unions. Labor unions opposed the cadillac tax on health insurers and progressives were on board, calling the president every name in the book for supporting it.

Fast forward to today. The President has twice nominated a very very pro-labor attorney to head the National Labor Relations Board (NLRB). A powerful ally in that position is more than organized labor could ever hope for.

None of the blacker than thou sites have commented on his defeat. Jane Hamsher sure hasn't. Was it on Ed Shultz, Rachel Maddow, or Keith Olberman?

This was a tough blow for organized labor today. I'm surprised that those who care so much about ordinary workers are so silent.
